Applicable to all SMS/MMS messaging programs operated by Fuel & Tire Saver Systems

1. Introduction and Scope

Fuel & Tire Saver Systems (“Company,” “we,” “us,” or “our”) is committed to protecting the privacy and personal information of individuals who participate in our text messaging programs. This SMS & Text Messaging Privacy Policy (“Policy”) describes how we collect, use, share, and protect your information in connection with our short message service (SMS) and multimedia messaging service (MMS) communications.

This Policy applies to all text messaging programs operated by Fuel & Tire Saver Systems, including but not limited to promotional alerts, transactional notifications, customer service communications, and appointment reminders. It supplements our general Privacy Policy and governs all SMS/MMS messaging activities in compliance with:

        The Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227

        The CAN-SPAM Act of 2003 (as applicable to electronic messaging)

        The CTIA Messaging Principles and Best Practices

        The Campaign Registry (TCR) 10-Digit Long Code (10DLC) regulations

        The Federal Communications Commission (FCC) rules and regulations

        Applicable state laws governing text messaging and consumer privacy

2.1 Information You Provide

When you opt in to receive text messages from us, we collect the following information:

        Your mobile phone number

        Opt-in date, time, and method (keyword, web form, paper form, verbal consent)

        Any information you voluntarily provide in response to our messages

        Name and contact information if provided during sign-up

2.2 Information Collected Automatically

When you interact with our SMS programs, we may automatically collect:

        Message delivery status and timestamps

        Carrier and device type information

        Opt-out requests and unsubscribe history

        Message engagement data (e.g., response rates)

3. How We Use Your Information

Fuel & Tire Saver Systems uses information collected through our SMS programs solely for lawful purposes, including:

        Sending you text messages consistent with the program(s) for which you opted in

        Providing transactional communications (e.g., order confirmations, appointment reminders, shipping notifications)

        Sending promotional offers, discounts, and marketing messages (where separately consented)

IMPORTANT: All the above
categories exclude text messaging originator opt-in data and consent; this
information will not be shared with any third parties.

4. Consent and Opt-In Requirements

4.1 Express Written Consent

Before sending you any marketing or promotional text messages, we will obtain your prior express written consent as required by the TCPA. This consent must be:

        Freely given, specific, informed, and unambiguous

        Provided via a clear affirmative action (e.g., texting a keyword, checking a box, signing a form)

        Accompanied by clear and conspicuous disclosure of what you are agreeing to receive

        Not conditioned on the purchase of any goods or services

4.2 Required Disclosures at Opt-In

At the time of opt-in, we will clearly disclose the following:

        The identity of Fuel & Tire Saver Systems as the message sender

        The nature and purpose of the messaging program

        The message frequency (e.g., “Message frequency varies” or specific cadence)

        That message and data rates may apply

        Instructions for opting out (e.g., “Reply STOP to cancel”)

        Instructions for obtaining help (e.g., “Reply HELP for help”)

 4.3 Transactional Messages

For transactional or informational messages (such as appointment reminders, purchase confirmations, or account alerts), we may send messages based on your existing business relationship with us. You will always be informed of how to opt out of these messages.

5. How to Opt Out

You have the right to stop receiving text messages from us at any time. To opt out of our SMS program(s), you may use any of the following methods:

Upon receiving your opt-out request, we will send you one final confirmation message and then cease sending you SMS messages within a commercially reasonable time (no more than 48 hours). Opting out of one program does not automatically opt you out of all programs; you must opt out of each program separately.

6. 10DLC Registration and Compliance

6.1 What is 10DLC?

10DLC (10-Digit Long Code) is a business messaging standard established by mobile carriers and the Campaign Registry (TCR) to improve the reliability and trustworthiness of business-to-consumer text messaging. Fuel & Tire Saver Systems is registered with the Campaign Registry and complies with all 10DLC requirements.

6.2 Our 10DLC Registration

As a registered 10DLC sender, Fuel & Tire Saver Systems:

        Has registered our brand identity with the Campaign Registry (TCR)

        Has registered all messaging campaigns with TCR prior to sending messages

        Operates only pre-approved messaging campaigns that have passed carrier vetting

        Maintains accurate and current campaign registration information

        Adheres to all carrier-specific 10DLC policies and code of conduct requirements

        Uses only registered phone numbers assigned to our approved campaigns

6.3 Prohibited Messaging Content

In accordance with 10DLC regulations and CTIA guidelines, Fuel & Tire Saver Systems will never send text messages containing:

        SHAFT content: Sex, Hate, Alcohol (to minors), Firearms, or Tobacco/Vaping promotions in violation of applicable law

        Phishing attempts or fraudulent content

        Malicious links or malware

        Deceptive or misleading information

        High-risk financial content (payday loans, cryptocurrency schemes)

        Content that violates any applicable federal, state, or local law

7. Message Frequency and Costs

Message frequency varies depending on the program(s) you have enrolled in and your interactions with us. Unless otherwise stated at the time of opt-in:

        Promotional/marketing programs: Up to 6 messages per month

        Transactional programs: Messages are sent as triggered by account activity

        Customer service programs: Messages sent in response to your inquiries only

Message and data rates may apply. Standard messaging rates charged by your mobile carrier will apply to all messages sent and received. Fuel & Tire Saver Systems does not charge separately for text message communications. Contact your wireless provider for details about your messaging plan.

8. Data Retention and Security

8.1 Data Retention

We retain records of your consent to receive SMS messages and your opt-in/opt-out history as required by applicable law and our regulatory obligations. Specifically:

        Opt-in records (consent documentation) are retained for a minimum of four (4) years

        Opt-out records are retained indefinitely to honor your preferences

        Message logs may be retained for up to 24 months for compliance and quality assurance

8.2 Data Security

We implement appropriate technical and organizational security measures to protect your mobile number and messaging data against unauthorized access, loss, or misuse. These measures include:

        Encryption of data in transit and at rest

        Access controls limiting who may view SMS consent records

        Regular security assessments of our messaging systems and vendors

        Employee training on privacy and data security obligations

9. Third-Party Service Providers

We may use third-party SMS platform providers and marketing technology vendors to operate our text messaging programs. These vendors are:

        Contractually prohibited from using your data for any purpose other than providing services to us

        Required to maintain appropriate security measures

        Prohibited from selling or sharing your mobile number with other parties

        Subject to our vendor privacy and security requirements

We require all third-party providers to be compliant with applicable laws, CTIA guidelines, and 10DLC registration requirements. We do not share mobile opt-in data with third parties for their own marketing purposes.

10. Your Rights and Choices

Depending on your jurisdiction, you may have additional rights regarding your personal information collected through our SMS programs, including:

        The right to access information we hold about your SMS interactions

        The right to request deletion of your mobile number from our SMS systems (subject to legal retention obligations)

        The right to correct inaccurate information

        The right to opt out at any time as described in Section 5

        The right to file a complaint with the FCC, FTC, or your state attorney general

12. Changes to This Policy

We reserve the right to update or modify this SMS Privacy Policy at any time. When we make material changes, we will:

        Where required by law, notify you of changes via text message or other means

Your continued participation in our SMS programs following notice of any changes constitutes your acceptance of the revised Policy. We encourage you to review this Policy periodically.

13. Governing Law

This Policy and all SMS messaging activities of Fuel & Tire Saver Systems are governed by the laws of the United States, including the TCPA, CAN-SPAM Act, and applicable FCC regulations, as well as the laws of the Commonwealth of Virginia.
