offers, account notifications, and other relevant information related to our fuel and tire efficiency

3. Message Frequency
Message frequency varies based on your account activity, purchase history, enrolled programs,
and communication preferences. Typical message categories and frequencies include:
• Order & Shipping Notifications: As triggered by order placement, fulfillment, and delivery

4. Costs and Charges
Fuel & Tire Saver Systems Company, LLC does not charge a fee for SMS messages sent through
this program. However, standard message and data rates may apply depending on your mobile
carrier and service plan. These charges are billed by and payable to your mobile carrier. Fuel &
Tire Saver Systems is not responsible for any charges imposed by your carrier. Please contact
your mobile carrier for details about your messaging rates.
STOP to Cancel: Reply STOP to any Fuel & Tire Saver Systems text message at any time to
unsubscribe. You will receive one final opt-out confirmation message. No further messages will be sent
unless you re-enroll.

6. User Responsibilities

7.3 Re-Enrollment
If you opt out and later wish to rejoin the SMS program, you may re-enroll at any time by following
the enrollment procedures described in Section 2. Standard terms and conditions apply upon reenrollment.

8. Privacy and Data Use
Your mobile number and any information you provide in connection with the Fuel & Tire Saver
Systems SMS program are governed by our Privacy Policy, available at

use, and disclosure of your information as described therein.
Fuel & Tire Saver Systems Company, LLC will not sell or share your mobile phone number with
unaffiliated third parties for their own independent marketing purposes without your explicit
consent, except as required by law or as described in our Privacy Policy.

9. Prohibited Use
You agree not to use the Fuel & Tire Saver Systems SMS program to:

FUEL & TIRE SAVER SYSTEMS COMPANY, LLC PROVIDES THE SMS PROGRAM “AS IS”
WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT
PERMITTED BY APPLICABLE LAW, FUEL & TIRE SAVER SYSTEMS SHALL NOT BE LIABLE
FOR:
• Delays, failures, or errors in SMS message delivery caused by your mobile carrier,
network outages, or technical circumstances beyond our reasonable control.
• Unauthorized access to messages received on your mobile device.
• Mobile carrier charges incurred by you in connection with the SMS program.

• Indirect, incidental, special, punitive, or consequential damages arising out of or related
to your use of or inability to use the SMS program.
In no event shall Fuel & Tire Saver Systems’ total liability to you in connection with the SMS
program exceed the greater of: (a) the total amount you paid to Fuel & Tire Saver Systems in the
six (6) months preceding the event giving rise to the claim, or (b) one hundred dollars ($100.00).

11. Modifications to These Terms
Fuel & Tire Saver Systems Company, LLC reserves the right to modify, update, or discontinue
these Terms and Conditions or the SMS program at any time, with or without prior notice. Material
changes will be communicated via SMS or posted on our website at www.fuelandtiresaver.com.
Your continued participation in the SMS program following notification of changes constitutes your
acceptance of the updated Terms. If you do not agree to the updated Terms, you must opt out as
described in Section 7.

12. Supported Carriers
The Fuel & Tire Saver Systems SMS program is available to customers on most major U.S. mobile
carriers, including but not limited to: AT&T, Verizon, T-Mobile, Sprint, Boost Mobile, Cricket
Wireless, Metro PCS, U.S. Cellular, and Virgin Mobile. Carrier availability is subject to change
without notice. Fuel & Tire Saver Systems is not responsible for the acts or omissions of any
mobile carrier.

13. Governing Law and Dispute Resolution
These Terms and Conditions shall be governed by and construed in accordance with the laws of
the state in which Fuel & Tire Saver Systems Company, LLC is registered, without regard to
conflict of law principles. Any disputes arising out of or related to these Terms or the SMS program
shall first be submitted to good-faith negotiation. If unresolved, disputes shall be resolved through
binding arbitration under the American Arbitration Association’s Consumer Arbitration Rules,
except that either party may seek injunctive or equitable relief in any court of competent
jurisdiction.
BY ENROLLING IN THE FUEL & TIRE SAVER SYSTEMS SMS PROGRAM, YOU WAIVE ANY
RIGHT TO A JURY TRIAL AND AGREE THAT ANY CLAIM SHALL BE BROUGHT IN YOUR
INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY
PURPORTED CLASS ACTION PROCEEDING.
